Should I get the dingoo a380 or a320?

I’ve been trying to find a hand held console for roms, and I came across the dingoo consoles. After seeing the a380 I found it to look quite pleasant, but I haven’t seen much of a large community out for it yet. I also saw the a320, and I’m hearing a lot of good things about it, but I really do like the design of the a380. I don’t want to purchase something for over 100 bucks, and regret it. Please feel free to post your opinion.

Is it illegal to have an NES emulator but not have games?

I don’t have an NES (Nintendo Entertainment System), but I have an emulator. I don’t have any NES games, however. I only downloaded D-Pad Hero, which is a spoof on Guitar Hero, and is a game that you download online for NES emulators. I downloaded the game and play it on an emulator. Is this illegal?

The emulator I play it on is on my dingoo a320 gaming device, just so you know.
I am not asking if I will get caught. I know I won’t. I just want to know if it is illegal.
